Senior Citizen cases settled within 3Months

IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH

Civil Revision No.6582 of 2008

Date of decision : 16.1.2009

Surinder Singh …..Petitioner

Versus

Malook Singh …Respondent

CORAM : HON’BLE MR. JUSTICE S. D. ANAND

Present: Mr. Shailendra Jain, Advocate for the petitioner.

S. D. ANAND, J.

Learned counsel for the petitioner states that he would be content and interest of justice would be served, if a direction is issued to the learned Trial Court to dispose of the trial itself within time bound frame. The petitioner claims to be a senior citizen aged more than 70 years and in frail health. He had undergone hospitalisation at AIIMS for three indicated periods of time. He is, otherwise, still under continued treatment at the AIIMS.

The cases pertaining to senior citizens have to be given priority,as per instructions issued by this Court from time to time. By the very nature of things, a person in advanced years of his life is entitled to insist upon expeditious judicial adjudication of the litigation, particularly when he is not in good health. That is something which the law can surely owe to a litigant of that category.

The petition is disposed of with a direction to the learned trial
Court to dispose of the trial itself within three months from the next date of hearing.

The acknowledgment (of a copy of this order) issued by the
concerned Judicial Officer shall be forwarded to the Registry of this Court.
Learned Sessions Judge shall himself maintain a tab to ensure that the case is disposed of by afore-mentioned date.
