O R D E R
Heard learned counsel for the parties.
2. The Principal, Rishi Valley School, Rishi Valley, Chittoor District, Madanapalle, Andhra Pradesh, has communicated to the District Judge, Chittoor, that there is no vacancy to accommodate the child Ayush along with Gautam this year in standard V. However, the Principal of the Rishi Valley School has graciously agreed to consider favourably the admission of the students for standard VI next year.
3. We direct the parents of the children to do the needful immediately so as to facilitate the admission in standard VI next year.
4. In order to avoid any further complaint regarding interim custody, in supersession of all earlier orders, the following orders are passed:
i. The child Ayush shall continue with the mother/Karuna Gadde till 02.10.2018 and he shall be handed over to the custody of the father/Sudarsan Rao Gadde before 5.00 P.M. on 02.10.2018.
ii. On the last day of October and succeeding months the custody of the child, in alternative months, shall continue, as above. The parties will handover the child before 5.00 P.M. at their respective residence on the last day of the month.
5. Once the child is admitted in the school, the available holidays will be shared equally between the parties. In order to avoid any confusion, we make it clear that the first phase of the holidays will commence with the mother. In all other respects the parties are directed to strictly abide by the terms of settlement.
6. With the above observations and directions, the contempt petition is closed.
7. Pending applications, if any, shall stand disposed of.
