Both the petitioners appear before us in person. Both of them candidly stated that they have married to other persons and the marriages with their spouses are subsisting.
Now, they live with each other and seek protection. The marriages of both the petitioners have not been terminated in accordance with law. During the subsistence of their marriages with other partners, it is not possible for the Court to provide security to such a couple who are, virtually, flouting the law of the land.
The sanctity of the marriage must be preserved. If a party wants to opt out, it can always seek a dissolution of the marriage in a valid manner. The Court cannot lend aid to people who do not abide by the law.
The writ petition is, accordingly, dismissed.
