The Kerala High Court in a significant judgment upheld that marital rape, although not penalised in India, is a good ground to claim divorce while dismissing a set of two appeals filed by a husband challenging the decision of the Family Court.
Now question is it only for women, and Women can misuse ? or even Men can file file for divorce on same ground, The judgment says its only for Women. ANOTHER GENDER BIASED OPTION FOR WOMEN TO MISUSE.
A spouse in a marriage has a choice, a choice not to suffer, which is fundamental to the autonomy guaranteed under natural law and the Constitution.
But Indian constitution is only for Women, it nowhere Judge women, they have all option to empower women, nothing to keep check on them even law is misused.
AS PER JUDGES:
Merely for the reason that the law does not recognise marital rape under penal law, it does not inhibit the court from recognizing the same as a form of cruelty to grant divorce. We, therefore, are of the view that marital rape is a good ground to claim divorce
WHAT IF WOMEN SLEEP WILLINGLY AND CLAIM RAPE?
WHO WILL KEEP A WATCH OF PRIVATE LIFE OF A COUPLE?
KEEPING CCTV VALID?
WHY NOT MEN ALSO CAN USE THIS?
WHAT IS THE PUNISHMENT IF CLAIM FIND TO BE FALSE?
and blind Law makers or Judges has no answer. for Women appeasement they can do anything. Most of the these laws and Judgments by Male judges, it clearly shows, who is responsible for the pathetic situation of Men in india.
